2. PURPOSE
These Terms and Conditions of Sale define the conditions applicable to the online sale of products offered by KMS District Art on its website.
The products offered mainly consist of artworks and photographs printed on various materials, intended in particular for interior decoration.
Products are made to order.
These terms apply to sales made to consumers located in particular in France, Germany, Spain, the Netherlands, Belgium, and the United Kingdom, subject to the mandatory provisions applicable in the consumer’s country of residence.
3. PRODUCTS
The essential characteristics of the products are presented on the product pages of the website.
Photographs and representations of the products are presented as accurately as possible. However, slight differences may occur, particularly depending on the screen used, display settings, or the characteristics of the printing material.
Products are made to order.
The products offered are not personalized according to the individual specifications of the customer, unless expressly stated otherwise on the product page.
4. PRICES
Prices are displayed on the website at the time the order is placed.
KMS District Art benefits from the VAT exemption scheme applicable to small businesses.
VAT is not applicable pursuant to Article 293 B of the French General Tax Code.
Any applicable shipping costs are displayed before the order is confirmed.
KMS District Art reserves the right to change its prices at any time. The price applicable to the order is the price displayed at the time the order is confirmed.
5. ORDER
The customer selects the products they wish to purchase and adds them to their shopping cart.
Before finally confirming the order, the customer can check its contents, modify quantities, and correct any errors.
Confirmation of the order constitutes acceptance of these Terms and Conditions of Sale.
The order becomes final once payment has been confirmed.
A confirmation email is sent to the customer at the email address provided when placing the order.
KMS District Art reserves the right to refuse or cancel an order in the event of payment issues, manifestly incorrect or incomplete information, or in the cases provided for by applicable law.
6. PAYMENT
Payment is due at the time the order is placed.
The available payment methods are indicated during the ordering process.
The order is processed after payment has been confirmed.
7. MANUFACTURING AND DELIVERY
As the products are made to order, the preparation time may vary depending on the product, material, and destination.
Applicable delivery times and shipping costs are displayed before the order is confirmed.
KMS District Art ships orders to the countries available at the time of ordering, including France, Germany, Spain, the Netherlands, Belgium, and the United Kingdom.
The delivery times provided are estimates. Delivery delays may, in particular, result from circumstances beyond the control of KMS District Art.
In the event of a significant delay or non-delivery, the customer has the rights provided for under applicable law.
8. RIGHT OF WITHDRAWAL
Where the right of withdrawal applies, the consumer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to provide a reason.
The procedures for exercising the right of withdrawal and the return conditions are detailed in our Return and Refund Policy.
The right of withdrawal does not apply in the cases provided for by applicable law, in particular to products that are clearly personalized or made according to the consumer’s specifications.
The mere fact that a product is made to order does not, by itself, constitute an automatic exclusion of the right of withdrawal.
9. STATUTORY WARRANTIES
KMS District Art is subject to the statutory warranties applicable to products sold to consumers.
The statutory warranty of conformity applies under the conditions provided for by applicable law.
The consumer also benefits from the statutory warranty against hidden defects under the conditions provided for by law.
These statutory warranties apply independently of any commercial warranty that may be offered.

Customers are encouraged to include photographs of the product and its packaging to facilitate the processing of their request.
10. LIABILITY
KMS District Art shall not be held liable for damage resulting from improper use of the product or failure to comply with any usage and maintenance instructions provided.
However, KMS District Art’s liability cannot be limited or excluded where applicable law prohibits such limitation.
11. INTELLECTUAL PROPERTY
The photographs, artworks, texts, logos, graphic elements, and other content present on the KMS District Art website are protected by intellectual property laws.
Any reproduction, representation, modification, adaptation, or use, in whole or in part, of the website content without prior authorization is prohibited, except where permitted by law.
The purchase of a product does not result in any transfer of intellectual property rights relating to the artwork or photograph reproduced.
12. PERSONAL DATA
Personal data collected when placing an order is processed in accordance with our Privacy Policy.
Such data may be used in particular to process orders, make payments, arrange delivery, communicate with the customer, and comply with applicable legal obligations.

These Terms and Conditions of Sale are governed by applicable law, without prejudice to the mandatory provisions from which the consumer may benefit in their country of residence where legally applicable.
16. AMENDMENTS TO THE TERMS AND CONDITIONS OF SALE
KMS District Art reserves the right to modify these Terms and Conditions of Sale, in particular to take into account legal, regulatory, or commercial developments.
The terms applicable to an order are those accepted by the customer at the time the order is confirmed.
